The Court :- The grievance of the petitioner is directed against a request for conversion of a sub centre into a main, independent and permanent M.R. shop in favour of the petitioner. The writ petition has been filed as far back as in 2006 and all that the petitioner prays for is his representation for conversion to be considered by the District Controller of Food and Supplies being the respondent no. 3.

Mr. Amitesh Banerjee, learned Senior Advocate appears on behalf of the State and submits, upon instructions, a memo dated 13th July, 2005. The District Controller of Food and Supplies has rejected the request of conversion on the ground that there is no provision in law whereby such a conversion can

be granted. Mr. Banerjee is directed to serve a copy of the memo dated 13th July, 2005 on the petitioner within a period of seven days from date. In view of the submission of Mr. Banerjee, nothing survives in the writ petition. WPO No. 1948 of 2006 is disposed of. However, there will be no order as to costs.

Interim orders, if any, stand vacated.
