The Court : GA/3/2013(Old No: GA/498/2013) is an application for discharge of the caveat.

It is submitted by the Registrar-in-Insolvency that the caveator, Mr. Ayan Sen has already expired and his legal heirs have been substituted, and, as such, the present application for discharge of caveat has become infructuous.

Accordingly, in view of the aforesaid submission, GA/3/2013 [Old No.GA/498/2013] stands dismissed being infructuous. This matter being PLA/199/2011 is placed at the instance of Registrar-in-Insolvency.

Let there be an order in terms of prayer [a] of the petition. The petitioner is directed to furnish a personal bond for a sum of Rs.5,60,000/- with one surety.

The petition stands disposed of.
