The Court :- This is an application for grant of letters of administration with regard to the estate left behind by the deceased. The deceased was a bachelor at the time of his death. His mother had pre-deceased him. The only surviving brother who qualifies as an heir in intestacy under Class-II of the schedule read with Section 8 of the Hindu Succession Act, 1956 is the applicant for letters of administration.

Considering the view of the department upon complete scrutiny, the application for grant of letters of administration is allowed by granting order in terms of prayer (a) of the petition subject to the applicant furnishing a personal bond for a sum of Rs. 27,000/- with one surety. The petition for grant of letters of administration stands disposed of, accordingly.
