The matter had appeared at the instance of the petitioner. It is submitted on behalf of the petitioner that by an order dated 4th December, 2023, a Coordinate-Bench had appointed a Sole Arbitrator who has expressed his inability to act as Arbitrator on personal grounds. A copy of the letter dated 6th March, 2024 be kept with the records.

In such circumstances, the petitioner seeks appointment of a substitute Arbitrator.

Accordingly, the Hon'ble Mr. Justice Subrata Talukdar (Retired), is appointed as Sole Arbitrator subject to the Learned Arbitrator communicating his consent in the prescribed format to the Registrar, Original Side of this Court within three weeks from date. The Advocate on Record of the petitioner

shall communicate this order to the Learned Arbitrator forthwith and positively within 7 days from the date of passing of this order. With the aforesaid directions, AP/797/2023 stands disposed of. (RAVI KRISHAN KAPUR, J.) S.Bag
