...for the respondent The Court: Both the parties state that the award can be set aside without entering into the merits of the matter. Both parties further consent to the appointment of an arbitrator to adjudicate the dispute between the parties afresh. All the points of contentions are kept open to be adjudicated by the learned arbitrator. Accordingly, Mr. Biswaroop Bhattacharya, Advocate (Mob. No. 9830454798) is appointed as the Sole Arbitrator to adjudicate the disputes between the parties.

The learned Arbitrator shall be at liberty to fix his fees in accordance with law.

In view of the above the impugned award dated 20.06.2019 is hereby set-aside.

Accordingly, AP-COM/399/2024 is disposed of.
