Counsel appearing for the petitioner submits that the Arbitrator who was appointed on 17th January, 2024 has communicated his refusal to act as such by way of a telephonic conversation but has refused to give anything in writing. Hence, counsel is unable to produce any written communication from the Arbitrator for the record.

Mr. Reetobroto Mitra, Counsel, is appointed in place and stead of the erstwhile learned Arbitrator subject to the newly appointed Arbitrator

communicating his consent in the prescribed format to the Registrar, Original Side of this Court within three weeks from date. The petitioner shall communicate this order on the newly appointed Arbitrator by 29th February, 2024.
