The Court: Repeated adjournments were prayed for on behalf of the plaintiff. On 31st August, 2022 none appeared for the plaintiff. On 22nd September, 2022 adjournment was prayed for on behalf of the plaintiff. Similarly, adjournments were also prayed for on behalf of the plaintiff on 3rd January, 30th January, 17th March and 11th May, 2023. On 16th June, 2023 the learned Counsel for the plaintiff submitted that the sole plaintiff expired on 16th April, 2023 and prayed for leave to file necessary application. Till today no application has been filed. On death of the sole plaintiff, the suit stands abated. Accordingly, the suit along with all pending applications stand dismissed as abated.
