The Court : The writ petitioner filed this writ petition to expedite the investigation in respect of the police case no. 133 of 2020 dated July 10, 2020 in Posta Police Station.

Mr. Naba Kumar Das, learned State Counsel appearing for the respondents State Authorities placed a report dated October 15, 2022 prepared and singed by the Officer-in-Charge, Posta Police Station. From the said report, it appears that warrant of arrest has already been issued. A copy of the report is taken on record.

In view of the above, this Court is of the firm view that the respondents State Authority and the police authority have taken necessary steps in the matter in accordance with law. However, they shall take further steps as expeditiously as possible in accordance with law. There is no scope for filing any affidavit in this writ petition, considering the prayer made in the writ petition and in view of the report furnished by the State.

In view of the above, this writ petition being WPO No. 2852 of 2022 stands disposed of without any order as to costs. Since affidavit are not called for, the allegations made in this writ petition are deemed not to have been admitted by the respondents. It is also made clear that the merit of this writ petition has not been gone into by this Court.
