The Court: This is an application alleging violation of the orders dated 9th October, 2023 and 18th October, 2023. The matter has been pending for a considerable period of time and diverse orders have been passed from time to time. During the course of this proceeding, it also transpired that the subject vehicle i.e. the hypothecated asset was in the custody of one Mr. Tapas Routh. Pursuant to orders of Court, Mr. Tapas Routh is personally present in Court. In terms of the directions of Court, Mr. Dasgupta was requested to appear on behalf of Mr. Tapas Routh.
It is submitted by Mr. Tapas Routh (in person) that the entire amount of Rs.1,30,000/- would be paid within four months. The alleged contemnor is willing to pay a sum of Rs.20,000/- by 30th May, 2025. Accordingly, the alleged contemnor shall pay a sum of Rs.20,000/- to the award holder by 30 May
2025. The remaining amount shall also be paid by installments commencing from 16 June, 2025 within a period of 4 months i.e by 16 September, 2025. Liberty is granted to the petitioner to file a fresh application in accordance with law, if the circumstances so warrant. In view of the above, the order of arrest shall remain stayed. All interim orders stand vacated.
With the above directions, CC/126/2023 alongwith the application being GA/1/2024 stands disposed of.
