It is submitted on behalf of the petitioner that for unavoidable reasons the petitioner was unable to be present when the matter was dismissed for non-prosecution. The respondent is represented and does not object to the prayer of the petitioner.

I have considered the averments in the application and I am satisfied that there is sufficient cause and good reasons as to why the petitioner was not represented when the matter was dismissed for non-prosecution. In view of the above, the order dated 9th January, 2024 stands recalled. AP/1345/2013 is restored to its original file and number. The petitioner is granted liberty to take appropriate steps for hearing of the matter AP/1345/2013.
