The Court:- This Court, by the previous order dated 5th January 2023, had heard the counsel for the parties on merit and had rejected the objection. Thereafter, the matter was adjourned because counsel for the applicant had made a request that instead of presiding arbitrator, a sole arbitrator be appointed and counsel for the respondents had sought time to obtain instructions in this regard.

Learned counsel for the respondents today has stated that she has no objection if the sole arbitrator is appointed. On the joint request of learned counsel for the parties, Hon'ble Justice Pranab Kumar Chattopadhyay, a retired judge of this Court, is appointed as sole arbitrator to resolve the dispute between the parties, subject to submission of declaration by the proposed Arbitrator in terms of Section 12(1) in the form prescribed in the Sixth Schedule of the Act before the Registrar, Original Side of this Court within four weeks from today.

Let this order be conveyed to the Arbitrator by the Registrar, Original Side, forthwith.
