The Court :- This is an application for grant of probate of the last Will and Testament dated 24th April, 2015 left behind by the abovenamed deceased.

It is submitted that the deceased was a bachelor who died leaving behind no legal heirs/heiresses in Class-I as specified in the schedule of the Hindu Succession Act, 1956. The parents predeceased him. The only class-II heiress being the sister of the deceased has consented to the grant. Considering the view of the department upon complete scrutiny, the application for grant of probate is allowed as the Will has been proved in common form by the affidavit of the attesting witness granting order in terms of prayer (a) of the petition.

The petition for grant of probate stands disposed of, accordingly. (ARINDAM MUKHERJEE, J.) snn
