...for defendant no. 3 The Court:- The plaintiff, namely, Smt. Rita Ghosh is in the witness box and submitted that she has already received Rs.10 Lakh in accordance with the deed of compromise. A sum of Rs.50 Lakh is yet to be received by her. She submitted that a gift deed has already been executed in her favour and a matrimonial suit being MS/90/2025 has been filed before the Family Court, Kolkata.

The remaining amount of Rs. 50 Lakh is deposited with the Learned Registrar, Original Side. Rs. 25 Lakh may be withdrawn by the plaintiff for the time being and rest of the amount along with accrued interest shall be withdrawn by her after all the disputes and litigations are over.

Till that time, the Learned Registrar, Original Side shall keep the sum of Rs.25 Lakh invested in any nationalized bank. Let this suit be decreed on compromised. The deed of settlement and this order shall be part of the compromise decree. The instant suit is disposed of accordingly, along with all pending applications.
