Mr. Ramendu Agarwal, Advocate for the plaintiff. The Court : The plaint has appeared in the list under the heading 'Presentation of Plaint'. At the time of presentation it is submitted on behalf of the plaintiff that the disputes between the proposed plaintiff and the proposed defendants which would have been the subject matter of the suit on the same being instituted by presenting the plaint have been settled. The proposed plaintiff, therefore, does not want to present the plaint to institute the suit. The written instruction received by the learned Advocate representing the proposed plaintiff for not proceeding with the case is placed before the Court and kept with the record.

In the aforesaid facts and circumstances, the registry is directed to de-register the suit as a number has been allotted on the plaint being filed in the computer section of this Court but has not formally entered the records of the Court which would have taken place on the plaint being presented. Since the proposed plaintiff is also not seeking liberty to file a

fresh suit on the self-same cause, the court fees paid for filing the plaint be returned to the proposed plaintiff after completing the necessary formalities. (ARINDAM MUKHERJEE, J.) pa
