Mr. Somak Bera, learned advocate, is appearing for the respondent. It is submitted by the learned advocate for the appellant that after the amendment in the law, the appellant has preferred an appeal being IPDPTA/34/2022 but unfortunately, the same was dismissed for default. Subsequently, by an order dated 19th January, 2024 the appeal being IPDPTA/34/2022 is restored.

Now, the appellant submits that AID/18/2022 is also connected with the similar order and as such the appellant do not want to press the AID/18/2022 and intent to proceed with IPDPTA/34/2022. In view of the submissions made by the appellant, AID/18/2022 is dismissed as withdrawn.

Consequently, the connected application is dismissed as withdrawn. Learned Counsel for both the parties submitted that no date is fixed with regard to the appeal being IPDPTA/34/2022. Let the appeal being IPDPTA/34/2022 be listed on 19th August, 2024 as "To Be Mentioned" for fixing the date of hearing. (KRISHNA RAO, J.) S.De
