It appears from the said Report that the assets of the company (in liquidation) have not yet been sold. There is also a question whether the Official Liquidator has taken possession of all the movable and immovable assets of the company (in liquidation) or not. In view of the aforesaid and in view of the decision reported in Action Ispat And Power Private Limited versus Shyam Metalics And Energy Limited reported in (2021) 2 SCC 641 and in A. Navinchandra Steels Private Limited versus Srei Finance Limited & Ors. reported in AIR 2021 SC 1180, the matter stands transferred to National Company Law Tribunal (NCLT).

The Department shall treat CP/874/2014 along with all connected applications as disposed of insofar as the records of this Court are concerned.
