ORDER SHEET WPO/1087/2016

IN THE HIGH COURT AT CALCUTTA

Constitutional Writ Jurisdiction ORIGINAL SIDE Ram Krishna Das.

Versus

The State of West Bengal & Ors.

BEFORE:

The Hon'ble JUSTICE ANIRUDDHA ROY Date : 18th July, 2022.

Mr. Debdutta Basu, Adv.

... for petitioner.

Ms. Deblina Chattaraj, Adv.

... for respondent nos.2-5.

Pursuant to the last order dated July 11, 2022, Mr. Basu, learned Counsel for the writ petitioner, has produced the arithmatical calculation on account of interest as directed therein. Let such calculation sheet be kept with the record.

According to the said calculation prepared by the petitioner, the quantum comes as Rs.45,983/- payable to the petitioner by the respondent employer.

Ms. Chattaraj, learned Counsel appears for the respondent nos. 25 and submits that she needs to take instruction on the said calculation from her client.

Considering the services rendered by the petitioner during his more than 30 years' employment and considering the quantum of the calculation, this Court thinks it fit to dissolve the issue once for all today

itself. Accordingly, the respondent nos.4 and 5, who are the apparopriate authorities, must disburse and pay a total sum of Rs.40,000/- to the petitioner as full and final settlement on the issue within a period of six weeks from the date of communication of this order. In course of hearing, it was pointed out by Ms. Chattaraj that no affidavit has been filed in this writ petition and it was wrongly recorded in the order dated July 11, 2022 that the affidavits were filed. Let it be understood that no affidavit was exchanged in this writ petition and the same was mistakenly recorded in the order dated July 11, 2022.

With the above observation and direction, the writ petition being WPO/1087/2016 stands disposed of.

Accordingly, interlocutory application, if any, stands disposed of. There shall, however, be no order as to costs. (ANIRUDDHA ROY, J.) K. Banerjee A.Rs. [C.R.]
