The Hon'ble Justice SAUGATA BHATTACHARYYA Date: 11th January, 2023 Appearance Mr. Ajay Kumar Bagaria, petitioner-in-person Mr. Ranajit Chatterjee, Advocate Ms. Manisha Nath, Advocate ...for the KMC The Court: This contempt proceeding has arisen out of the order passed by this Court on 10th August, 2022 on alleged violation of the direction as contained therein directing the appropriate authority of KMC to take decision on the issue of waiver of interest and penalty in the event application is made by the applicant thereby approaching the concerned authority of the KMC to waive penalty and interest. Today, the matter is heard in presence of the applicant who is appearing in person and the learned Advocate representing the alleged contemnors.

Pursuant to the previous order passed by this Court on the contempt application, affidavit of compliance has been filed before this

Court today which is taken on record. From the said affidavit, it appears that Chief Manager (Revenue) - North, Kolkata Municipal Corporation had passed an order on 28th December, 2022 on the issue of waiver of interest and penalty as directed by this Court.

In view of such order dated 28th December, 2022 passed by the appropriate authority of the KMC, the present contempt application is disposed of since it appears that the order passed by this Court is complied with.
