...For the Petitioner The Court :- The last Will and Testament dated 11th January, 2007 in English language was made and published by one Sunil Kumar Chakraborty in his lifetime, who had thereafter expired on 16th April, 2008. An application with regard to the aforesaid Will had been filed for grant of probate. The execution of the said Will had been proved by the declaration of one of the attesting witnesses. The mother and wife of the deceased namely, Parul Bala Chakraborty and Arundhuti Chakraborty respectively had predeceased the testator, who had been survived by his only son as his legal heir and legal representative namely, Ashis Chakraborty, who consented to the instant application for grant of probate in respect of the estate of the deceased, as aforesaid, filed by Sri Govardhan Rateria, one of the executors of the aforesaid Will and Testament dated 11th January, 2007.

Subsequently, citations were issued and objections to grant of probate applied for in PLA 387 of 2008 were not received. The Department had issued a 'No Caveat' certificate. The Will had been proved to be in solemn form by the affidavit of the attesting witnesses. Considering the report of the Department, having scrutinized the records as well as the application, order in terms of prayer (a) of the petition is granted.
