The Court : It is submitted on behalf of the parties that a proceeding under Section 34 of the Arbitration and Conciliation Act, 1996 challenging the award sought to be executed is pending before this Court. By an order dated 15 November, 2021, there is also an order of stay of the impugned award. In such circumstances, EC/223/2009 stands dismissed.

Liberty is granted to the award holder to file a fresh execution application if the circumstances so warrant in accordance with law. Liberty is also granted to the award holder to take back the original award sought to be executed after replacing of the same with a photocopy thereof.
