The Court:- The respondent authorities, for the purpose of restricting unauthorized entrance at the police barrack at 300 and 306, B.B. Ganguly Street, Kolkata-700012, have installed two gates; one in the Eastern side and the other in the Western side of the premises no.306. The big gates in between the two premises have small gates. The shop rooms in the Western side of premises no.300, B. B. Ganguly Street, allege that their entry gets restricted because the big gate is locked and the shop owners do not have the keys. According to the petitioners, keys of the big gate have not been handed over to them and as such they cannot enter through the big gate. Learned advocate representing the State respondents has obtained instruction and has submitted that keys of both the big and the pocket gate have been handed over to the shop owners in the Western side of the premises no. 300, B. B. Ganguly Street.

The aforesaid submission is denied by the learned advocate representing the petitioners.

As the authorities have already disclosed before the Court that the keys of the big gate and the pocket gate have been handed over to the shop owners of the shop room nos. 6, 7 & 8 as appearing in Annexure-A at page 10 of the report in the form of an affidavit filed by the State respondents, accordingly, the authorities shall ensure that the keys are actually handed over to the respective petitioners. The grievance of the petitioners will be redressed if their access to the lane in between the two premises remains unhindered.

In the event keys are not given, it will be open for the learned Advocate-onrecord of the petitioners to mention the matter before this Court for further necessary orders.

Affidavit-in-reply filed by the petitioners in Court today is taken on record. The writ petition stands disposed of.
