The Court : It is submitted on behalf of the parties that they have entered into an agreement for settlement on 7th January, 2023 which they intend to file before the National Company Law Tribunal, Kolkata Bench (in short 'NCLT') in Company Petition No.(IB) 1135 of 2020 being a petition filed by the defendant in the suit. In the aforesaid facts and circumstances, it is submitted on behalf of the plaintiff that the plaintiff is no more desirous in continuing with the suit and intends to withdraw the same. Considering the submissions made by the parties and the prayer of the plaintiff, the suit is dismissed as withdrawn. Application, if any, filed in the suit also stands dismissed.

Interim order, if any, stands vacated.

The copy of the agreement for settlement as aforesaid is kept with the records.
