The Court:- The learned advocate representing the defendant submitted that the plaintiff after filing the suit in the year 2005 did not appear to contest the same.

It was further submitted that the written statement was filed in the year 2005 and, thereafter, the hearing of the instant suit did not proceed for absence of the plaintiff.

It seems that notice had been served upon the learned advocate representing the plaintiffs by the learned advocate representing the defendant. However, none appeared to represent the same. Under such circumstances, the instant suit be dismissed for nonprosecution. (ANANYA BANDYOPADHYAY, J.) A Dey
