The Court : On the prayer of learned counsel for the petitioner, leave is granted to the petitioner to withdraw the present application under Section 9 and renew the self-same prayer in the application under Section 17 of the Arbitration and Conciliation Act, 1996 which has already been filed before the arbitral tribunal which has been constituted in the meantime, particularly keeping in view the fact that the matter has been fixed before the tribunal tomorrow.

It is made clear that this court has not entered into the merits of the prayers.

AP/864/2022 is, accordingly, disposed of as withdrawn in the light of the above observations.
