THE COURT:- Perused the report of the Deputy Sheriff of Kolkata. Today the rule was made returnable. It appears that the rule could not be served upon the respondents. Such report has been filed with Annexure. Mr. Sastry, learned counsel for the applicant submits that the suit is proceeding after the order was passed by this Court and the defendants have entered appearance in the suit. He produces the orders dated July 4, 2023 and August 9, 2023passed by the learned Judge, Vth Bench, City Civil Court at Calcutta. The orders indicate that the suit is proceeding and the defendants have been asked to file their written statement.

Under such circumstance, no useful purpose will be served in keeping the application pending.

Accordingly, ALP/10/2022 is disposed of with a direction upon the learned Court below to conclude the suit and dispose of the same within one year from this date, without granting unnecessary adjournments to the parties. Liberty to communicate.

The court has not entered into the merits of the suit. Learned court below shall act on the basis of a server copy of this order.
