...For the Respondent The Court : This application is by the National Highways Authority of India for a direction on the Official Liquidator for demarcated the area of the Company in Liquidation in respect of a land which was acquired by the Company prior to the order of winding up.
Learned Counsel appearing for the NHAI submits that 0.7 acres of land in Uttar Dinajpur was acquired by the Company in 2010 which is now required to be made over to the NHAI.
Learned Counsel also submits that compensation to the land losers has already been deposited with the District Magistrate in 2014 and seeks information on whether this amount has already been withdrawn by the Company in Liquidation Learned Counsel appearing for the Official Liquidator submits that there are several interested parties in this application including a secured creditor (State Bank of India) who are required to be heard in this matter. Counsel suggests that the petitioner take steps to find out the interested parties from the Office of the Official Liquidator.
Upon hearing learned Counsel, the petitioner is directed to approach the Official Liquidator by way of a letter or otherwise or take inspection for information on the parties who were required to be heard in this matter. The petitioner will thereafter serve all the parties, so that they are represented on the next date.
