Das and Others Vs The Union of India and Others Mr. Rakesh Pal Gobind ... for the petitioner Mr. Rakesh Kumar ... for the respondent Nos. 3-4 February 05, 2026 [AKB] Item No. 7 The learned counsel for the writ petitioner Mr. Rakesh Pal Gobind has drawn the attention of this Court that by virtue of the order dated December 16, 2022 passed in WPA/227/2019 the Secretary, Ministry of Environment, Forest and Climate Change, Government of India was directed to appoint an independent auditor to look into the records and to ascertain as to whether any excess payment has been made to the petitioners and/or as to whether the petitioners are entitled to any amount in addition to the amount they have already received.

It is also directed that the Secretary, Ministry of Environment, Forest and Climate Change, Government of India, if necessary, shall approach the Ministry of finance, Government of India for suggestion of a suitable name from their panel auditors for the aforesaid purpose. In view of such direction the audit firm Satya Sudhindran and Co. was engaged and an audit report was prepared and the same was communicated to the writ petitioner.

Now the learned counsel for the petitioner has submitted that inspite of such audit report the respondent No. 1 and 2 are not disbursing his admissible amount in their favour. The learned counsel for the respondent Nos. 3 and 4 has also submitted that in compliance of the order dated December 16, 2022 necessary steps have been made on behalf of the respondent No. 1 and 2 for audit.

However, from the affidavit-of-service filed earlier it is found the matter has been brought to the notice of the learned counsel for the respondent Nos. 1 and 2 but today none appears to represent them. The respondent No. 1 and 2 are hereby directed to consider the audit report furnished by the Firm, namely, Satya Sudhindran and Co. and to disburse the due amount, if any, to the petitioners after complying with all legal formalities within twelve weeks from the date of communication of this order.

The learned counsel for the writ petitioners is to communicate this order to the respondent No.1 and 2. The writ petition WPA/1/2026 is, thus, disposed of. (Apurba Sinha Ray, J.)
