Heard the learned counsel for the writ petitioner and the learned counsel for the respondent-Administration. 2.

The petitioner has approached the Central Administrative Tribunal for confirmation claiming parity with one T.Leena. The CAT has directed as follows:- "5.3. In view of the above, as the applicants herein and T. Leena are similarly situated, the applicants are entitled to get the same benefit, if otherwise found fit, in terms of the earlier order passed by this Tribunal as well as the Hon'ble High Court, therefore, respondents are directed to take appropriate steps to confirm the applicant's service from the date they would be entitled to in terms of their appointment letter and grant consequential benefits, within a period of 03(three) months from the date of receipt of a certified copy of this order."

In the contempt proceeding arising out of the said order, the Tribunal has been pleased to extend the time for submiting a compliance report of the order dated 08.08.2024 passed in OA/351/00347/2024/AN till 21.01.2025.

The learned counsel for the petitioners had submitted on the earlier occasion that when the matter was taken up, the authorities are dragging their feet in complying with the order passed by the Tribunal.

We thus asked the learned senior counsel appearing for the respondent-Administration to seek instructions in the matter.

Insofar as the petitioners are concerned, learned senior counsel has produced a written instructions received from the Assistant Director (Admn) in the Directorate of RD/PRIs/ULBs,the same be kept on record. It is stated in the written instructions that the matter regarding the petitioners' confirmation has been approved by the competent authority (the Chief Secretary, Andaman and Nicobar Administration). The date of approval has been given as 15.01.2025. It is stated in the written instructions that as per the Recruitment Rules, the three member Departmental Confirmation Committee (DCC) is now required to process the same after obtaining clearance from the vigilance and other departments, which process is likely to take two weeks.

Extending the time granted by the Tribunal till 03.02.2025, we find that the pendency of the writ petition would serve no useful purpose, the writ petition is accordingly disposed of.

The matter is left to be considered by the Central Administrative Tribunal.
