Lavanya Sundari Mr.KMB Jayapal ... for the petitioner January 9, 2024 [SR] Item No.42 The petitioner prays for expeditious disposal of Other Suit No. 67 of 2021 which was pending before the learned Civil Judge (Senior Division) Port Blair. According to the petitioner, the defendant has not taken any steps in the said suit. The prayer of the petitioner for expeditious disposal of the litigation is innocuous.

However, it is for the learned Court to decide how the suit shall proceed. The contention of the petitioner that the written statement has not been filed and inordinate delay has been caused, is not taken into consideration by this Court. It is for the learned Trial Court to decide such issue. However, this Court is simply observing that the learned Trial Judge will make efforts to dispose of the Other Suit No. 67 of 2021 in accordance with law. As the suit is of 2021, it is excepted that the said suit should be disposed of within next one and half years.

This Court has not made any observation on the merit of the suit. As this order will enure benefit of all the parties, the service of prior notice of this revisional application upon the defendant is not required.

However, the petitioner shall serve a copy of this revisional application alongwith a copy of this order upon the opposite party within a period of one week from date. Accordingly the revisional application being CO/3/2024 is disposed of.
