Learned advocate appearing for the respondent No. 4 submits that the appeal has been preferred before the Deputy Commissioner not only in respect of the notice but by way of amendment the order dated 31.12.2021 has also been challenged which was accepted by the said office on 25th July, 2022. Till date no notice have been issued to the respective parties.

Accordingly, I direct the Deputy Commissioner, South Andaman to issue notice to all the affected parties within a week from date.

As Mr. Shatadru Chakraborty is representing Deputy Commissioner he is directed to communicate this order immediately to the said office. A date would be fixed within ten days and within four weeks thereafter the Deputy Commissioner will try to pass a speaking order. In case the petitioner before this court namely Shri. K.Jairam finds that the time which has been fixed by this Court will lead to the adjudication being infructuous, in that case if any application be taken out by Shri K.Jairam, the Deputy Commissioner will consider his prayers so that the further adjudication before the Deputy Commissioner do not become infructuous.

With the aforesaid observations WPA/18/2022 is disposed of.
