Respondents Mrs.Anjili Nag, Advocate ... for the petitioners Mr.S.Chakraborty, Advocate ... for the respondents December 16, 2021 [GNC] Item No.12 The writ petitioners assail the notices dated September 15, 2019 and November 27, 2019 by which, the respondent authorities expressed the intention to acquire the land of the petitioners bearing survey No.94 measuring 1.65 hectares situated at Bimblitan village, Tehsil Port Blair, South Andaman. Learned advocate appearing for the petitioners submits that the petitioners are entitled to compensation by taking into consideration the circle rate notified by the Lieutenant Governor in October, 2019 governing the land.

Learned advocate appearing for the Administration submits, on instructions, that subsequent to the filing of the writ petition, the authorities decided not to acquire the land belonging to the petitioners at the present moment. In such circumstances, since the Administration desires not to acquire the land of the petitioners for the present, the impugned notices for acquisition are quashed. However, this order will not prevent the authorities from issuing fresh notices for acquisition if they deem it appropriate.

Needless to mention such notices will be issued in accordance with law.

WPA/9283/2020 is disposed of accordingly.
