The writ petition is seeking implementation of the demolition order dated 29th November, 2024, which, as per submission of the parties, is now pending consideration in an appeal. The appeal is in the Court of the Municipal Appellate Authority (Deputy Commissioner), and bearng No.FA/33/2024/5646.

Learned counsel for the petitioner submits that the order impugned before the appellate authority was passed at the instance of the present writ petitioner and, therefore, he may be permitted to make an application for being made party in the appellate proceedings.

In view of the liberty as prayed for; and since the matter is now to be considered by the appellate authority where the petitioner ought to be heard, pendency of the writ proceedings would serve no useful purpose.

The writ petition is, therefore, disposed of with liberty to the petitioner to appear before the appellate authority, and apply for being made a party, as noted above. ( Madhuresh Prasad, J. )
