Zilla Parishad and others Mr.Mohammed Tabraiz .... for the petitioner Mr.Shatadru Chakraborty Mr. Dibesh Dwivedi ... for the respondents January 16, 2024 [SR] Item No.14 The petitioner is aggrieved because the representation with regard to the release of pending salary, grant of increment; bonus and other benefits and allowances, have not yet been disposed by the Chief Executive Officer, Zilla Parishad, South Andaman District.
The petitioner contends that, pursuant to the order passed by the Hon'ble Apex Court, thereby rejecting the Special Leave to appeal filed by the authorities, there was no impediment in denying the dues in terms of salary, increment, bonus, house rent allowance, travelling allowance, educational allowance etc.
It appears to this Court that the matter is pending for final disposal. The Special Leave to Appeal has been dismissed. The order of the Hon'ble Division Bench has attained finality.
Without going into the merits of the issues involved, the writ petition is disposed of with a direction upon the Chief Executive Officer, Zilla Parishad, South Andaman
District to treat the writ petition as a representation and dispose of the same, in accordance with law. As the matter is pending since long, the matter should be disposed of within a period of six weeks from the date of communication of this order. The petitioner will be heard and a reasoned order will be passed and communicated to the petitioner within the afore-mentioned period.
As the affidavits are not called for, the allegations are deemed to be denied, except those which are admitted and are matter of record.
