Kumar ...for the Respondents July 03, 2024 (M.A.Mobin) Item No.59 Learned Counsel for the petitioners had assailed the order dated 08.01.2024 in the present Writ Petition. Learned Counsel for the petitioners states that he has preferred a Title Suit No.16 of 2024 pending before the Civil Judge (Senior Division), Mayabunder. Learned Counsel for the petitioners has drawn attention of this Court to an order passed by the Division Bench of this Court in MAT No.1663 of 2007 reported in 2007(3) CHN 718.
It is the contention of the learned Counsel for the petitioners that since he has moved the Civil Court, the present Writ Petition has become infructuous in view of Section 202, Sub-clause 8 of the Andaman & Nicobar Islands Land Revenue & Land Reforms Regulations, 1966.
In view of the same learned Counsel for the petitioners does not wish to press the present Writ Petition.
The present Writ Petition is disposed of in view of the fact that once the petitioners have availed their remedies before the Civil Court, the proceedings before the Tehsildar are deemed to be stayed in terms of Section 202(8). In view of the above contention the present Writ Petition is disposed of.
