As recorded in the order dated 30th January, 2024, learned counsel representing the victim had informed the Court that the victim does not wish to proceed with the case filed against the petitioner/accused.

The court thought it fit to test the stand by meeting the victim today in chambers at 1.30 pm. Nobody else was present apart from the victim.

It appears from the statement made by the victim that the victim was pressurized to make certain statements to the prosecution, more specifically, the police officers. The victim made it clear that the victim does not wish to proceed any further with the case and that the hearing of the case would prejudice her present status as a student in a college in the Andamans.

CRR/11/2024 is accordingly disposed of in terms of the above and in terms of the victim's specific desire to withdraw the charges against the petitioner.

Since the allegations made in the petition against the State/ its officers are in the form of defence to the impugned proceedings, the allegations are deemed not to have been admitted.

Pahargaon Police Station Case No.106 of 2023 dated 19th July, 2023 charge sheet No.90 of 2023 and Sessions Case No.33 of 2023 are accordingly quashed and set aside. The presence of the victim is dispensed with. ( Moushumi Bhattacharya, J. )
