The Andaman and Nicobar Administration and another Ms. G.Mini ... for the petitioner Mr. V.D.Sivabalan ... for the Administration January 16, 2024 [SR] Item No.19 The petitioner seeks an order of disposal of the mutation case, which is pending before the Tehsildar, Port Blair. Mutation has been prayed for in respect of survey No.346, measuring an area of 0.034 hectares and survey no.MP/30/2/1, measuring an area of 1 hectare, situated at Bimblitan Village, under Port Blair Tehsil, District South Andaman.

The petitioner claims under a Will executed on January 16, 2019, by one Shamoo @ Samoo.

The petitioner relies on several documents annexed to the writ petition, which would indicate that steps have been taken in Form J, under Rule 135(3) of the Andaman and Nicobar Islands Land Revenue and Land Reforms Rules, 1968 and notice of mutation to the interested parties have already been issued. It also appears that the summons to appear was issued in Form K. Thus, the matter is in

progress, but the authorities have sat tight over the same without deciding the issue involved.

Without going onto the merits and the issues involved, this writ petition is disposed of by directing the Tehsildar, Port Blair to dispose of the mutation case within a period of six weeks from date of communication of this order, upon giving an opportunity of hearing to the petitioner, other interested parties and pass a reasoned order. The order shall be communicated to the petitioner within a period of one week thereafter.

The writ application is accordingly disposed of. ( Shampa Sarkar, J. )
