IN THE HIGH COURT AT CALCUTTA

CONSTITUTIONAL WRIT JURISDICTION CIRCUIT BENCH AT PORT BLAIR *** WPA/9132/2020 Ms. Shailaija Singh ... Petitioner Vs The Medical Council for India and others ... Respondents Mr. Gopala Binnu Kumar, Advocate ... for the petitioner Mr. Rajinder Singh, Advocate ... for the respondent No.2 September 16, 2021 (AKB) Item No. 68 The petitioner, a medical student sought for a direction upon the respondent authorities, particularly respondent no. 2, to make appropriate correction in the result of the petitioner uploaded in website of the University on 19.02.2020 wherein the petitioner was declared as failed in respect of the subject Pathology II MBBS professional examination.

Accordingly, a direction was sought for to declare her as successful in the said subject, inter alia, on the ground therein in the writ application.

Now at this stage, Mr. Gopala Binnu Kumar, learned counsel appearing for the petitioner has pressed in service a written instruction that the petitioner does not want to proceed with the case and submits to withdraw this writ application as she does not want to pursue further because her internal assessment mark and attendance of third MBBS Part I has been uploaded and the result was declared by the Pondicherry University in the II MBBS Course in respect of the pathology subject in which she has passed and nothing remains in this writ to be decided at this point of time. Hence, the writ application being WPA/9132/2020 is allowed to be withdrawn as not pressed.

The parties are directed to act on the server copy of the order downloaded from the official website.
