I have heard the learned counsel for the parties. 2.
On the basis of the undertaking to pay the cost assessed by the Coordinate Bench at Rs.10,000/- by Justice Rajasekhar Mantha on 19th December, 2022 in course of this week, I permit the writ petitioner to withdraw the writ petition and file statutory appeal under Regulation 28(2) of the Andaman and Nicobar Islands Land Revenue and Land Regulation, 1966 within a period of four weeks from date. 3.
I make it clear that in the event no cost is paid in terms of this order, the writ petition shall stand dismissed. 4.
In the event the second appeal is filed in terms of the aforesaid Regulation, the Secretary (Revenue) is directed to dispose of the said appeal preferably within a period of six months from the date of filing of the appeal. 5.
I make it clear that I have not gone into the merits of the matter.

The writ petition is disposed of, however, there shall be no order as to costs.

Urgent certified photostat copy of this order, if applied for, be supplied to the parties upon compliance of usual formalities.
