The Union of India and others Mr. Gopala Binnu Kumar ... for the petitioner Mr. Shatadru Chakraborty Mr. Dibesh Dwivedi ... for the respondents January 17, 2024 [SR] Item No.4 The order dated December 14, 2023 passed by the learned Central Administrative Tribunal, Kolkata Bench, Circuit Bench at Port Blair in OA/315/1597/2023, has been challenged before this Court. The grounds of challenge are :- (a) The learned Tribunal ought to have directed the authorities to dispose of the representation of the petitioner dated November 16, 2023, along with the supporting documents which included commentaries of different authors. Such analysis by the authors would allegedly indicate that the answers given by the petitioner in the examination were correct. (b) The learned Tribunal ought to have directed the authorities to dispose of the said representation within two or three weeks instead of three months as the urgency involved was grave. The selection of the petitioner was being held up.

(c) The authorities should have been directed to dispose of the matter on the basis of the server copy of the order, instead of certified copy. Awaiting supply of a certified copy, would cause unnecessary delay.

Mr. Shatadru Chakraborty, learned advocate for the Administration submits that there is no serious irregularity in the order of the learned Tribunal.

We have heard the parties. Perused the record. The authorities shall dispose of the representation of the petitioner, upon by taking into consideration all the materials relied upon by the petitioner in support of his contentions. Such documents will also include the commentaries by different authors. The disposal shall be within three weeks, on the basis of the server copy of this order. The decision shall be communicated to the petitioner, within a week thereafter. The order of the learned Tribunal is modified accordingly. The writ application is accordingly disposed of.
