IN THE HIGH COURT AT CALCUTTA

[ CIRCUIT BENCH AT PORT BLAIR ] *** WPA/46/2025 Smti. Pawan Kumari Vs.

The Lieutenant Governor and Others Mr. R. Pradeep .... for the petitioner Ms. Babita Das .... for the respondents March 13, 2025 [SR] Item No.2 1.

I have heard the learned counsel for the parties. 2.

It appears that the R.C. Case initiated by the writ petitioner for some landed properties to be mutated in her favour on the basis of a Will executed by his brother, is pending before the Tehsildar, since 4th October, 2024. 3.

Under such circumstances, this Court directs that the Tehsildar to dispose of the representation/application submitted by the writ petitioner on 4th October, 2024 within a period of eight weeks from the date of communication of this order after giving reasonable opportunity of hearing to all the interested parties by passing a reasoned order which shall be communicated to the parties within two weeks from the date of passing of the order .

4.

I make it clear that I have not gone into the merits of the disputes.

5.

Since no affidavit has been called for, all allegations made in the writ petition are deemed to have been denied by the respondents.

6.

With the above observations and directions, the writ petition stands disposed of. However, there shall be no order as to costs.
