This is the case wherein a divorce was granted by the Family Court, Port Blair between the husband and wife, the wife is the petitioner herein and the husband is the private respondent No.3.
Subsequent to the order passed by the Family Court, the private respondent married once again and has included the name of the new wife in his service record. Subsequent to this event, the order of the Family Court was brought in appeal before the Hon'ble High Court and the High Court has by an order dated 2nd March, 2020 reversed the order of the Family Court and nullified the divorce granted by the Family Court. In the light of these developments, the petitioner has sought for her name to be once again recorded in the service record of the private respondent No.3.
Today, in Court, the new wife of the private respondent has also appeared and submitted that CAN/1/2022 has been filed for being added as party in this writ petition. By consent of the parties, the application bearing CAN/1/2022 is treated as on day's list and is disposed of by allowing the intervener to be added as a party in this writ petition.
Without going into the merits of the case, in my view, this matter can be disposed of with a direction upon the authority concerned to pass a reasoned order after granting an opportunity of hearing to the petitioner, the private respondent No.3 and the new wife of the private respondent No.3. Such reasoned order is required to be passed within a period of two weeks from date and the same should be communicated to all the parties within two days of passing of the same.
With the above directions, the writ petition and the application being CAN/1/2022 are disposed of. ( Shekhar B. Saraf, J. )
