Jayapal ... for the petitioner Mr. Shatadru Chakraborty Mr. Dibesh Dwivedi ... for the respondents October 12, 2023 [SR] Item No.9 The petitioner seeks implementation of the order passed by the Tehsildar, Port Blair on 17th December, 2021. Upon demarcation of the plots by the authority in compliance with a direction of this Court dated 20.02.2022 in WP No.51/2020, the authority has held that the private respondent, in addition to his recorded area, is also in occupation of an area of 0.0033 hectares out of survey No.194/2 total area of 0.0170 hectares which belongs to the writ petitioner. The writ petitioner was advised to approach the appropriate authority for redressal of his grievance, if any.

Learned counsel for the petitioner submits that the petitioner seeks to file a comprehensive representation ventilating his grievance before the concerned authority and prays for a direction upon the concerned authority to consider the representation at the earliest.

Learned counsel for the Administration submits that the third respondent be directed to consider the representation in accordance with law.

In view of the above, the writ petition is disposed of with liberty to the petitioner to submit a comprehensive representation to the third respondent within two weeks from date. The third respondent is directed to consider and

dispose of the representation within six weeks from the date of receipt thereof upon affording a reasonable opportunity of hearing to all concerned including the petitioner in the light of the observation made in the order of the Tehsildar, Port Blair dated 17th December, 2021, in accordance with law.The decision taken by the authority shall be communicated to the petitioner within a week thereafter.

The writ petition being WPA/62/2022 is accordingly disposed of. There shall, however, be no order as to costs. Urgent photostat certified copy of this order, if applied for, may be supplied to the parties upon compliance of usual formalities.
