1. It is submitted on behalf of the Appellant that the present Appellant is not in custody.
2. In view of such, this Court considers that the instant bail application has become infructuous.

1. Learned Advocate appearing on behalf of the Private Respondent submits before this Court that a talk of settlement is going on between the Appellant and the Private Respondent and on account of his client's illness he is
unable to come to Andaman for giving an appropriate instructions to his learned Counsel.
2. Learned Advocate for the Appellant as well as learned Advocate for the Private Respondent thus prays for an appropriate order for listing the matter before the next available Circuit Bench.
3. Considering the submissions, let the matter go out of list for the present.
4. Liberty to mention.
