Ms. G. Mini, Member AWARD The dispute between the parties has been listed for determination by the Lok Adalat and the parties having compromised /settled the case/matter, the following award is passed in terms of the settlement. FMAT (MV)/1/2025 and FMAT (MV)/2/2024 are disposed of analogously upon settlement. Both the appeals have been filed by the respective appellants aggrieved by the judgement dated September 13, 2024 passed in MACT Case No. 09 of 2018.
In FMAT (MV) /2/ 2024 the parties have entered into a compromise that the claim will be settled upon disposal and the appeal shall be disposed in the following manner.
The Insurance Company shall pay a lumpsum amount of Rs. 5,00,000/- (Rupees Five Lakhs only) towards settlement of the claim and such payment shall be made within a month to the appellant Smt. Raj Kumari. The amount shall be transmitted to the bank account of the appellant Smt. Raj Kumari by RTGS or any other electronic mode of transfer.
Smt. Raj Kumari shall provide the bank details to the Insurance Company, if not already submitted.
Both the appeals being No. FMAT (MV)/1/2025 and FMAT (MV)/2/2024 are disposed of including all connected application. (Aravindh Rejendiran) Branch Manager The New India Assurance Co.
