March 24, 2022 [GNC] Item No.7 This is an application under Article 226 of the Constitution of India wherein the petitioner is aggrieved by the inaction on the part of the respondent authorities, being the respondent No.1 in hearing the appeal filed by the private respondents. This is a case wherein upon a complaint made by the petitioner an order of demolition was passed by the Port Blair Municipal Council and against such order the private respondents have filed an appeal before the Deputy. The said appeal is pending for the past three months and no hearing have taken place.

I have heard counsel appearing for the parties and perused the materials on record. In my view, this writ petition can be disposed of by directing the Deputy Commissioner, South Andaman district, Port Blair to grant an opportunity of hearing to the petitioner and pass a reasoned order within a period of six weeks from date.

I make it clear that no unnecessary adjournments should be granted to either of the parties.
