The Union of India and others Mrs. Anjili Nag ... for the petitioner January 20, 2023 [SR] Item No.3 The writ petition is presented with a prayer for expeditious disposal of the Original Application, being OA/1838/2022 (Port Blair), pending before the Central Administrative Tribunal, Kolkata.

In the Original Application, validity of the charge sheet issued against the applicant is under question. The grievance, which has been ventilated on behalf of the petitioner today, is that though the original application was fixed by the Tribunal on 5th January, 2023, the same was not heard on said date. It is also not known to the writ petitioner that when this matter will be taken up for consideration.

It further appears from the order dated 24th November, 2022 that there was a direction by the Tribunal upon the respondents to file reply and it has been submitted by Mrs. Nag, till date, no copy of the said reply has been supplied to the applicant.

Therefore, considering the submissions made on behalf of the petitioner, it appears that when the original application is going to be listed and will be taken up for final consideration on exchange of pleadings, is uncertain. In view of the aforesaid situation, this Court requests the learned Central Administrative Tribunal, Kolkata, to make sincere endeavour to dispose of the original application pending before it at an early date, but preferably within a period of six months from date.

However, the learned Tribunal is further requested to fix up a date for taking into the record the pleadings, which may have been used by the parties, in the meantime, ensuring disposal of the original application, as directed by this Court herein above.

With the aforesaid direction, the writ petition stands disposed of.

There shall be, however, no order as to costs. All parties shall act on the server copy of this order duly downloaded from the official website of this Court, pending application of certified copy upon compliance of formalities.
