Mr.
Gopala Binnu Kumar, learned advocate representing the petitioners submits that the pending Tribunal case may not be allowed to continue in an endless manner, causing prejudice to the valuable rights of the petitioners. Several dates, according to Mr. Gopala Binnu Kumar, have been adjourned giving sufficient accommodation to the other sides, but, even after giving such accommodations, the Tribunal case could not be disposed of as yet.
No other point is raised requiring address by this Court.
The only contention, thus, expressed by the writ petitioners is against the delay caused in the disposal of the pending tribunal case.
Mr.
Shatadru Chakrarboty, learned advocate representing the Administration, submits that for the sufficient reasons, there has been delay caused in the disposal of the original application, but he has nothing to say as against proposed expeditious disposal of the pending tribunal case.
Having considered the submissions of both sides, the present writ petition, being CO.CT/1/2023, stands disposed of requesting the Tribunal to ensure expeditious disposal of the original application mentioned hereinabove, after causing disposal of interlocutory application, if any pending, subject to the suitability and convenience of the tribunal, but without granting unnecessary adjournment, unless extremely unavoidable, preferably within a period of four months from the date of communication of this order.
Since we have not called for any affidavits, the allegations contained in the writ petition are deemed not to have been admitted.
This order is passed without prejudice to the rights and contentions and without going into the merit of this case. The writ petitioners to make communication of this order to the respondents and the learned advocate appearing before the Tribunal as well as to the Tribunal taking advantage of this order in the meantime.
All parties shall act on the server copy of this order duly downloaded from the official website of this Court, pending application of certified copy upon compliance of formalities.
