Petitioner renews prayer for bail.

It is submitted that the petitioner is in custody for more than 280 days and charge sheet has been filed. It is further submitted that first recovery was 45 grams of psychotropic substance and subsequently there was recovery of 10 grams. Therefore, it should not be considered as seizure of commercial quantity from the petitioner as alleged.

Learned advocate representing the State has opposed the prayer for bail and it is submitted that previously a Coordinate Bench has rejected the bail application on 13th December, 2024. 4.

Case Diary has been produced in order to substantiate that the alleged recovery is more than commercial quantity. 5.

We have perused the materials available on record and examined the case diary wherefrom it appears prima facie there is an involvement of commercial quantity.

Considering the rigor of section 37 of NDPS Act, 1985, we are inclined to reject the bail application. Hence, application being CRM(NDPS)/3/2025 stands rejected.

Case diary is returned to the learned advocate representing the State.
