Vijay Kumar .... for the petitioner Mr V.D.Sivabalan ... for the respondents January 22, 2024 [SR] Item No.8 The petitioner is aggrieved by the inordinate delay caused by the Tehsildar, Port Blair Tehsil in mutating 0.0090 hectares of land comprised in Survey No.7/1/1 situated at Haddo Village, Port Blair Tehsil, South Andaman District. The petitioner acquired such land under the Will of the erstwhile owner, namely, Late S.Ravi, brother of the petitioner. The authorities are directed to take immediate steps on the basis of the application for mutation, strictly in accordance with law, upon granting an opportunity of hearing to the petitioner and all other interested persons. If the application is found to be in order and there is no impediment in granting such mutation, necessary mutation certificate shall be issued to the petitioner, within a period of eight weeks from date of communication of this order.

In case it is found by the authority that the mutation cannot be granted, the petitioner shall be supplied with the reasons, within the aforementioned period. The petitioner shall have the liberty to proceed according to law. This court has not gone into the merits of the issues involved. As no affidavits have been called for, all allegations are deemed to be denied, except those which are admitted or which are borne out by the records.

The writ petition is accordingly disposed of. ( Shampa Sarkar, J. )
