Respondents Mr. KMB Jayapal ... for the petitioner Mr.Salim Mohammed ... for the respondents March 16, 2022 [GNC] Item No.4 Leave is granted to the petitioner to make the Director, Directorate of Audit and Budget, Andaman and Nicobar Islands, Port Blair, as a party in this writ petition and serve a copy of the writ petition upon him.

This is an application under Article 226 of the Constitution of India wherein the petitioner is aggrieved by the inaction on the part of the respondents in not releasing pension to the petitioner inspite of the petitioner having submitted all relevant documents including succession certificate.

Counsel on behalf of the respondent authorities submits that proposal for pension being released is going back and forthwith with the Directorate of Audit of Budget and he is hopeful that the pension shall be released soon. In my view, this matter can be disposed of with the direction upon the respondent authorities to expedite the matter to issue Pension Pay Order (PPO) within a period of six weeks from date and thereafter start pension in accordance with law. Needless to mention that arrear pension shall also be paid to the petitioner within two weeks from the date of issue of Pension Pay Order.

With the above directions, this writ petition is disposed of. ( Shekhar B. Saraf, J. )
